The following Website terms and conditions (hereafter ”Website Terms and Conditions”), consisting of the terms and conditions of use and sale (hereafter ”Terms and Conditions of Use and Sale”) the privacy policy (hereafter ”Privacy Policy”) and the cookie policy (hereafter ”Cookie Policy”) govern and regulate the access and use of the Website as well as offer and sale of products marked with the ”Samsares” trademark (hereafter ”Product(s)”) on the Website. All information is provided in English language and is compliant with the Swiss law. Samsares has the right to change, replace and update these Website Terms and Conditions at its sole discretion without prior notice. The new updated version of these Website Terms and Conditions takes effect as soon as it is published on the Website. 

Please read the above mentioned legal information before using the Website and ordering products on the Website. By accessing and using the Website as well as by purchasing the Products on the Website, you agree to be bound by these Terms and Conditions of Use and Sale, by the Privacy Policy and by the Cookie Policy (hereafter ”Terms, Conditions and Policies”).

Below are the explanations of the descriptive terms, used in these legal notes:

– description ”User(s)” describes a person or persons using the Website with or without disclosing their identity;

– description ”Website Terms and Conditions” implies all terms and conditions that govern and regulate the offer and sale of Products on the Website. These Website Terms and Conditions consist of: the Terms and Conditions of of Use and Sale, the Privacy Policy and the Cookie Policy. 

– description ”Terms and Conditions of Use and Sale” implies all terms and conditions of use and sale which together with the Privacy Policy and the Cookie Policy govern and regulate regulate the offer and sale of Products on the Website;

– description ”Privacy Policy” implies all privacy policies which together with the Terms and Conditions of Use and Sale and the Cookie Policy govern and regulate the offer and sale of Products on the Website;

–  description ”Personal Data” refers to all personal data about Users which is collected when Users visit the Website and/or Samsares social media accounts and/or use Samsares services. 

–  description ”Cookie Policy” refers to the policy that governs and regulates the use of cookies and other automated data collection tools on the Website.  

1. TERMS AND CONDITIONS OF USE AND SALE

These Terms and Conditions of Use and Sale together with the Privacy Polica and the Cookie Policy govern and regulate the use of the Website as well as the offer ans sale of Products on the Website. Please read these Terms, Conditions and Policies before using this Website and ordering Products on the Website. Any continued use of the Website indicates that the User (hereafter ”User(s)”) has acknowledged and fully accepted these Terms, Conditions and Policies. 

The access to and use of the Website is allowed exclusively for personal non-commercial purposes, which should in no way be connected to the Users trade, business or professional activity.

The Website is established, managed and maintained by Samsares, a limited liability company with registered office in Switzerland, Ob dem Hügliacker 35, Binningen 4102, and VAT number CHE-328.940.986.

1.1. THE PURPOSE OF THE WEBSITE

Through this Website Samsares provides the following:

– content about Samsares brand and its Products, including information and inspirational content about the features and quality of Products, services and the brand, ass well as news, events, corporate information and legal notes;
– a remote sales platform where Products are offered for sale and can be purchased;
– services, including help and support provided by the customer service (hereafter ”Customer Service”), processing of information provided to Samsares by the Users and Customers, processing of payments, processing of orders, delivery of purchased Products, processing of returns, exchanges and cases of warranty, managing, maintaining and updating all technical aspects of the Website as well as all content published by Samsares on the Website.

1.2 SAMSARES OBLIGATIONS AND LIMITATIONS OF LIABILITY

1.2.1 Performance and security of the Website

Samsares takes reasonable and appropriate technical, organisational and administrative measures to ensure proper and secure functioning of the Website. Nevertheless, Samsares cannot guarantee for the total security of information contained within the Website due to general data security and privacy limitations inherent to the Internet. Except for cases of gross negligence, Samsares cannot be held liable for any direct or indirect damages that may result to the Users from the use of the Website, which may include such damages as data losses and transfer of viruses or malware that may negatively affect or destruct Users’ electronic devices. Users browse, navigate and use the Website at their own risk. Samsares cannot be held liable for the fraudulent and unauthorised use of data saved on and extracted from the Website by the third parties. All Customers must safeguard the security of their accounts on the Website by changing their passwords regularly and never sharing their usernames and their passwords with any third parties. Samsares cannot be held liable for disclosing personal information about the Customer to anyone who has logged into the Customer’s account by using the Customer’s login credentials. All information about privacy, personal data protection and cookies policy is described in the article 2 (Privacy Policy) and in the article 3 (Cookie Policy).

Although Samsares has adopted all reasonable measures to ensure proper functioning of the Website, it cannot guarantee that the Website will operate continuously, without any interruptions and errors due to the connection to the Internet and interference of the third parties operating either with malicious intend or when enforcing legal regulations. Samsares cannot be held liable for any failure to access the Website and loss of data arising out of any event beyond Samsares reasonable control.

1.2.2 Content

It is Samsares responsibility to provide correct, accurate, actual (up-to-date) and compliant with Swiss law content on the Website (hereafter ”Content”). The Content may include information about the Products offered for sale on the Website, information about the services that Samsares provides before, during and after the purchase of these Products, information to support and facilitate marketing of Products, as well as data about regulatory terms, conditions and policies. Samsares takes all reasonable care to ensure that the Content within the Website is accurate, correct and up-to-date. However, Samsares cannot be held liable for the accuracy and completeness of the Content at all times, except for its liability for gross negligence and as otherwise provided for by Swiss law.

Samsares cannot guarantee that the Website is available globally and that the Content within the Website is appropriate, legal and compliant with the regulations in every country of the world. Samsares cannot be held liable for any suspension or any termination of access to the Website arising out of any event beyond Samsares reasonable control.

Samsares takes great care to present the Products on the Website as accurately as possible. However, Samsares cannot guarantee that the appearance of real Products perfectly matches the images on the screen which very much depend on the Users Internet browser and monitor quality. Samsares cannot be held liable for any such differences that may occur.

1.2.3 Products

It is Samsares responsibility to ensure that all Products offered and purchased on this Website:
– comply with regulations of Swiss law and specifications provided in the product descriptions;
– are free of material defects and workmanship errors;
– are delivered to the recipient in new and undamaged condition.

Natural variations of precious stones are not considered material defects. Some level of impurities and color variations may occur which is not considered a flaw, but a unique characteristic of a natural product. Samsares only uses best quality, carefully examined and selected natural precious stones. Some of these natural precious stones will be treated by methods which are accepted in the industry as standard methods to improve the color or the hardness of natural precious stones (like heating of sapphires or oiling of emeralds). Samsares takes great care to ensure that all diamonds and precious stones used to manufacture Samsares Products derive from legitimate sources which operate in compliance with the United Nations resolutions and are not in any way related to any on the conflict zones.  

Samsares cannot be held liable for any damages of any nature that might arise while using the Products purchased on the Website. The total amount of Samsares liability in respect of the purchase of Products under these Terms and Conditions is limited to the amount paid by the buyer for the purchase of the Products.

1.2.4 Services

Samsares commits to provide the following before, during and after sales services:

– supports by the Customer Service which includes providing information, help and assistance in ordering, delivery, returns and refunds, exchanges and warranty claims of the Products purchased on the Website;

– correct processing of all orders;

– secure processing of all payments;

– safe deliveries of all orders within the indicated period of time to the address provided by the Customer;

– efficient and prompt processing of returns, refunds and exchanges;

– warranty on all Products purchased on the Website and efficient processing of all warranty claims.

More detailed information about all services related to the sale of Products on the Website is described below in the articles 1.6-1.11.

1.3 PRIVACY AND PERSONAL DATA PROTECTION

All information about privacy, personal data protection and cookies policy is described in the article 2 (Privacy Policy) and in the article 3 (Cookie Policy).

1.4 USER RIGHTS AND OBLIGATIONS

The access to and use of the Website is allowed exclusively for personal non-commercial purposes, which should in no way be connected to the User’s trade, business or professional activity. Any continued use of the Website indicated that the User has acknowledged and fully accepted the Terms and Conditions of Use and Sale as well as the Privacy Policy and Cookie Policy. If the User does not agree with all or parts of these Terms, Conditions and Policies, the User should not continue to use the Website. 

Under the above mentioned conditions, the User can visit and surf all authorized pages and parts of the Website and access all Content contained in these pages and parts. The User can contact Customer Service within the operating times and obtain information and support regarding Products and Services offered on the Website. The User can create and manage a customer’s account on the Website consequently becoming a customer (hereafter ”Customer”): The Customer can purchase all Products offered for sale on the Website and make payments on the Website. 

Only Users over the age of 18 can create a customer’s account on the Website and purchase Products. The Customer can indicate to where the purchased Products should be delivered and track the delivery process until receiving the order. The Customer has a right of withdrawal and can terminate the purchase contract within 14 days after receiving the order without any reason. The Customer can make warranty claims in case there’s reason for such claims. The Customer can share their personal content on the Website and on other Samsares accounts, including questions, comments, feedback, testimonials, endorsements, suggestions, ideas, concepts, drawings, images, photos, audio and video material. 

When using the Website the User is obliged to:

– not use the Website or any Samsares services for any purpose that is illegal, fraudulent, malicious or otherwise prohibited in the Terms, Conditions and Policies;

– not use the Website or any Samsares services for any purpose that is illegal, fraudulent, malicious or otherwise prohibited in the Terms, Conditions and Policies;

– not to attempt to access any areas or features of the Website such as servers, systems, networks and data that are not authorized to access;

not hack the Website in any way such as sending, storing and installing harmful computer programmes, documents, files and scripts containing viruses, malicious codes and other harmful agents for any reason whatsoever;
– not use any automated and manual systems, applications or devices that could interfere with, disrupt, inhibit and negatively affect the performance, integrity and security of the Website, Samsares ability to provide the services and other obligations, as well as the ability of other Users to fully use the Website and Samsares services;
– not attempt to extract other Users’ personal information and/or login credentials;
– not use another Samsares Users’ accounts without their permission;
– not create an account using the name of another person without this person’s permission;
– not provide any offensive or unlawful content which may contain pornography, violence, offence or threats, and/or may promote hate, violence or any unlawful activities;
– not use the Website and Samsares services in any way with intend to threaten, harass, abuse, stalk, defame or impersonate others, including Samsares employees, affiliates, parenting institutions and business partners;
– not use or develop any links and hyperlinks connecting the Website or parts of it to other websites, systems and programmes without prior written consent of Samsares;
– not copy, modify, distribute, sell, or lease any part of the Website, Samsares Products and services.

Any violation of these provisions is subject to the prosecution and penalties governed by the Swiss and international law.

1.5 USER SUBMISSIONS

The User is ultimately responsible for all content that the User provides on the Website.

Any submissions provided by the User on the Website, including feedback, testimonials, endorsements, questions, comments, suggestions, ideas, concepts, drawings, images, photos, audio and video material (hereafter ”Submission(s)”) are non-confidential and non-proprietary. This means that Samsares has the right to use these Submissions without compensating or mentioning the User. Additionally, these Submissions will not be treated as private information and could be viewed by others. Once the User posts these Submissions on the Website or on Samsares social media accounts, they become sole property of Samsares. When providing these Submissions the User grants Samsares an unrestricted, worldwide, royalty-free, irrevocable, transferable and perpetual right to use the content of these Submissions in a number of ways which are consistent with the Privacy Policy, including, but not limiting to, publishing, storing, displaying, reproducing, modifying, editing, developing and distributing.

User’s Submissions on Samsares social media accounts may be published on the Website.

Samsares has no control over, and shall not be held liable for any damages resulting from the use or misuse by any third party of the User’s content voluntarily made public through any part of the Website or through Samsares social media accounts.

The User is solely and ultimately responsible and liable for the legitimacy and legal consequences of their Submissions and must ensure that their Submissions do not infringe or violate the rights of any third parties, including, but not limited to, intellectual property rights, copyrights, patents and trademarks, rights of privacy, confidentiality and trade secret obligations. Additionally, the User must warrant that their Submissions do not contain any form of “spam” and hacking material.
Samsares periodically monitors and reviews the content provided by the Users on the Website and on Samsares social media accounts. Samsares reserves the right to edit, remove and delete content provided by the Users on the Website or on Samsares social media accounts if this content is considered to be abusive, offensive or violating these Terms, Conditions and Policies.

1.6 OFFER OF PRODUCTS

1.6.1 Compliance with regulations

All Products offered on the Website are new and compliant with regulatory and conventional standards. All Samsares Products are made from 750 gold. Samsares only uses best quality, carefully examined and selected natural precious stones. Some of these natural precious stones will be treated by methods which are accepted in the industry as standard methods to improve the color or the hardness of natural precious stones (like heating of sapphires or oiling of emeralds). Samsares takes great care to ensure that all diamonds and precious stones used to manufacture Samsares Products derive from legitimate sources which operate in compliance with the United Nations resolutions and are not in any way related to any on the conflict zones.  

1.6.2 Information about the Products

All information about the Products provided in the description on the Website complies with the current legal and regulatory requirements of Swiss law. Information about the weight of gold and carats of precious gemstones is average and based on the size 53 for rings and size M for bracelets. Therefore, the actual weight and carats of precious stones in the real item may vary slightly from the information provided in the Product’s description. Thought the Products on the Website are presented as accurately as possible, the actual appearance of Products may slightly differ from the images on the screen depending on User’s browser and monitor quality. Samsares cannot be held liable for these slight differences that may occur. 

1.6.3 Availability of Products
 
All orders are subject to inventory availability. Only Products with the ”Add to Basket” button are available for purchase at the moment of visiting the Website. If the desired Product is not available at the moment of visiting the Website, the Customer may contact Customer Service for an advice about the availability of the desired Product. Samsares takes great care to ensure that the actual levels of inventory match the information about availability of Products on the Website, but sometimes an error may occur. If the Product(s) become unavailable after the order is placed, the order will be cancelled and the Customer will receive an order cancellation email. The payment for the cancelled Product(s) will be immediately refunded.

1.6.4 Prices

All prices on the Website can be displayed in Swiss Francs (CHF), in Euros (EUR) and in United States Dollar (USD). Currencies can be changed in the tab which is located in the right upper corner of the footer. All prices include Swiss VAT (7,7 % of the total price). Currently Samsares doesn’t offer VAT exempt purchases meaning a deduction of the Swiss VAT from the purchase price. Retail prices depend on the prices of materials and services and are subject to change at any time. All prices displayed on the Website at any moment of time are final. 

1.7 ORDERING PROCEDURES

1.7.1 Creating a customer’s account

To place an order, the User must have a customer’s account on the Website. A User who creates a customer’s account on the Website becomes a Customer.

To access an existing customer’s account or create a new customer’s account the Customer should click on the person’s icon on the top right corner of the screen. 

To create a new customer’s account the Customer should fill a valid email address into the box marked as ”NEW CUSTOMERS” and click ”Register”. A ”my account” page will open and an email confirming new account registration will be sent to the email address provided by the Customer during registration. If the registration confirmation email is not received, the Customer should check the spam folder. The Customer should first create a new password by clicking the link provided in the new account registration email. The password can be later changed in the ”My account” page by clicking on the ”Account details” directory. After registration the Customer may fill ”My account” page with personal information, shipping and billing addresses and payment methods to speed up the checkout process in the future. 

It is Customer’s responsibility to provide a valid email address and create a secure password for the account. The first part of Customer’s email address will be used as the username for the Customer’s account. The username and the password are strictly personal and should not be shared with others.  

1.7.2 Selecting Products

The Customer selects the desired Products and places them to the basket by clicking on ”Add to Cart” button. Rings and bracelets must be selected in their correct size. To help the Customer choose the correct size, Samsares has created size guides which are available on every Product page. The products placed in the basket are not reserved until the full checkout process has been completed.

1.7.3 Checking out

Once ready to check out, the Customer must click on the shopping bag icon at the top right corner of the screen and all the Products which were selected to purchase will be displayed. The Customer can review the contents of the cart by clicking on the ”View cart” button. The Customer must check the content of the basket before proceeding to checkout. After clicking ”Proceed to Checkout” button a page will be displayed with the summary of the selected Products, their prices, payment options, as well as boxes to fill billing and shipping information. The Customer must enter the shipping address, the billing address and select the desired payment method. Samsares cannot be held liable for any mistakes made by entering the shipping address and other information during the checkout process.

1.7.4 Customer’s confirmation of the order

Before placing order, the Customer must read the Website Terms and Conditions and click the box indicating that the Customer acknowledges and agrees to these Website Terms and Conditions. If the box is not clicked, the system will not allow to place the order on the Webpage. The Customer is responsible for reviewing all the details of the order before proceeding to payment. In case credit card is chosen as a payment method, the Customer can  confirm the order and initiate the payment by clicking on ”Place order” button. In case Paypal is chosen as a payment method, the Customer will be directed to the Paypal login page. After logging into the Customer’s Paypal account, the Customer can once more review the order before initiating the payment. 

1.7.5 Payment

A full payment must be made when ordering Products. Following payment methods are available:

– Credit cards ( Visa, MasterCard )

– Paypal 

The Customer must be the holder of the credit card or the Paypal account provided for payment. Samsares takes all reasonable measures to make the Website secure. All credit/debit card transactions on the Website are processed using Stripe, a secure online payment gateway that encrypts the card details in a secure host environment. The payment details will not be stored on Samsares servers. Once the payment is validated by the Customers bank, an order confirmation email with all order details will be sent to the email address provided by the Customer. Once the payment is received, the ordered Products will be prepared and shipped within 48 hours to the Customer’s selected destination. At this point, The Customer will receive a shipping confirmation email with the billing receipt and the order tracking number. If the order confirmation and the shipping confirmation emails are not received, the Customer should check the spam folder. It is recommended that the Customer saves and keeps a printed or digital copy of the order confirmation and the shipping confirmation. 

1.7.6 Delivery
 
All Products are shipped from Switzerland and can be delivered to residential or company addresses specified in the order. For safety reasons, Samsares doesn’t deliver to P.O. boxes, distribution agencies, and parcel shops. 

We offer free standard delivery to the following countries: Austria, Belgium, Croatia, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, USA.
 

International deliveries to countries outside the shipping list may be organized by contacting our Customer Service. In this case, the cost of delivery must be paid by the Customer and will depend on the destination and the delivery method. 

International orders are subject to local import duties and taxes which must be paid by the recipient upon or after delivery.  

Items that are in stock will be prepared and handed over to our shipping partner within 1-3 days after receiving the payment. Items that are made to order will ship within 4-6 weeks after your payment is received. 

All shipped orders are insured during the time they are in transit to the shipping address specified by the Customer and can be tracked by clicking on the tracking number provided in the shipping confirmation email. Our partner offers an option of On Demand Delivery which enables the Customer to schedule the delivery time while the parcel is on its way. Delivery within Switzerland can take 1 to 2 working days after the parcel was shipped. Delivery to international destinations can take 5 to 7 working days after the parcel was shipped. 

Samsares takes great care to ensure that all orders are delivered within the indicated time period, but sometimes delays can occur due to unforeseen circumstances, local custom procedures or traffic disruptions. All deliveries beyond the above indicated delivery period are considered delays. In such delays occue, the Customer can execute the right of withdrawal after receiving the order and return it indicating delayed delivery as the reason for return. 

Since all our shipments are trackable, loss during delivery is very unlikely. However, due to unforeseen and unfortunate circumstances which are out of Samsares control, it can occur that the parcel will be lost or permanently damaged while in transit. In this case Samsares will cancel the order and issue a full refund. 

If the order could not be delivered to the recipient after multiple attempts, it will be considered as ”undeliverable parcel” and will be shipped back to our headquarters in Switzerland. In this case we will cancel the order and issue a refund, deducting the cost of shipping and return. 

1.7.7 Receiving

A signature is required at the time of receiving the parcel, at which point responsibility for the purchased goods passes to the recipient. On the same day the Customer will receive a delivery confirmation email.

Shortly after delivery the Customer should carefully examine the condition of the delivered order (including the packaging) and check whether the size, color of gold and gemstones of the delivered items correspond to the characteristics of the ordered items. If a wrong item/size/color of the Product was delivered, the Customer should contact the Customer Service to organize the replacement of the correct item. If the Products were delivered damaged, the Customer should send an email to the Customer Service within 7 working days after delivery, providing order number, photographs and description of all observed flaws. Damages reported later will not be treated as warranty case and will not be eligible for a refund or replacing.

The procedure of dealing with issues related to the delivery of damaged or wrong Products is described in the article 1.9 (Warranty).

1.7.8 Order cancellation

The Customer cannot cancel the order while the order is being processed or is being delivered to the specified shipping destination. Nevertheless, the Customer has a right of withdrawal from the purchase after receiving the order and can return the ordered Product(s) for up to 14 days after receiving the parcel without providing any reason. The returns procedure is described in the article no 1.8 (Returns and Exchanges).

Samsares reserves the right to cancel the order due to the following reasons:

– Ordered Product becomes unavailable

All orders are subject to inventory availability. Samsares takes great care to ensure that the actual levels of inventory match the information about availability of Products on the Website, but sometimes an error may occur. If the Product(s) become unavailable after the order is placed, the order will be cancelled and the Customer will receive an order cancellation email. The payment for the cancelled Product(s) will be immediately refunded.

– Payment has been refused

If the payment is refused or rejected by the issuing center, the order will be cancelled and the Customer will receive an order cancellation email. In this event the Customer could contact the Customer Service who might offer an alternative payment method.

– Suspicion of fraud or illegitimate purchase

Samsares offers Products for sale exclusively to the retail customers either for their personal use or as a present. Additionally, only Customers over the age of 18 can purchase Products on the Website. Samsares reserves the right to cancel any suspicious order at its own discretion.

– Loss or permanent damage of the order during delivery

Since all our shipments are trackable and we only use the best shipping agents, loss during delivery is very unlikely. However, due to unforeseen and unfortunate circumstances which are out of Samsares control, it may occur that the parcel will be lost or permanently damaged. In this case Samsares will cancel the order and issue a full refund.

– Undeliverable order

If the order could not be delivered to the recipient after multiple attempts, it will be considered as ”undeliverable parcel” and will be shipped back to our headquarters in Switzerland. In this case we will cancel the order and issue a refund, deducting the cost of shipping and return..

1.7.9 Errors while ordering

Samsares cannot be held liable for any mistakes which were made by the Customer when entering information or selecting options while registering new account, adding Products to the basket and checkout procedure. Should any errors occur, the purchase is considered final and valid. However, Samsares is always committed to the Customer’s satisfaction and will make every effort to find the best solution in case of an accidental error. If the Customer has provided a wrong shipping address and the Products were not yet dispatched, it is possible to change the shipping address by contacting the Customer Service. It is not possible to change the shipping address while the parcel is already in transit. If the Customer has provided a wrong shipping address and the Products were delivered to this address and received there, it is Customer’s responsibility to redeem these Products from the receiving party. If the parcel was not accepted by the recipient, it will be sent back to Samsares headquarters in Switzerland. In this event, Samsares will suspend the order and inform the Customer about the situation. If the Customer prefers to cancel the order, Samsares will do so and refund the price of the Product. The shipping and return cost will not be refunded. If the Customer prefers to keep the order and ship it to the right address, Samsares will do so. In this case, the new shipping costs will be calculated and charged to the Customer.

1.7.10 Retention of information about all orders

Information about all orders will be stored in Samsares system for 7 years from the last date of the Customer’s active use of Samsares services on the Website which requires disclosure of the Personal Data (f.e. creating a customer’s account, purchasing, subscribing to the newsletter, opening newsletter emails, contacting Customer Care or making a Submission). After this period, Customer’s account will be deactivated and Customer’s Personal Data will be permanently erased. All information about storing and processing Customers’ data is described in Article 2 (Privacy Policy).


1.8 RETURNS AND EXCHANGES

1.8.1 Returns

The Customer has the right to withdraw from the purchase and can return the purchased Products without providing any reason within 14 days of receiving the order. The return should be submitted by contacting Customer Service. After submitting a return request, the Customer will receive a returns request confirmation email with a returns authorization number and the returns form. Once the return is authorized, the Customer can proceed with shipping the package to the address provided in the returns form. The Customer is free to choose the courier for the shipping of the return package. While the returned package is in transit, it is under the Customer’s responsibility. Therefore we advise the Customer to choose a courier with a traceable and insured service. The cost of return must be paid by the Customer and will not be refunded. 

The items should be returned in their original packaging in unused condition. Personalized items are not eligible for returns. 

Once the returns package is received, the returned items will be reviewed and verified by our in-house team. If the Products were sent back in their original condition, we will make a full refund of the item’s price to the original payment method. The cost of local duties and taxes that were paid upon delivery will not be reimbursed. Refund payments will be processed within 5 working days. 

If the Products are returned with signs of wearing or damage, or if original packaging and accompanying materials (including all boxes, pouches, accessories, certificate of authenticity, labels, booklets, etc.) are missing, damaged, or incomplete, a full refund will not be authorized. In this case, we will notify the Customer that a partial refund is available. Alternatively, the Customer might choose to arrange the return of such items back to the Customer.  

If the purchased item was a present, the recipient cannot exercise the right to return the item and get a refund. This right is reserved exclusively to the Customer who has made the purchase.


1.8.2 Exchanges

We offer free exchanges of the purchased items within 14 days after the order is received. The Customer can exchange the size of the purchased item. Exchanges for the different items cannot be made. To create an exchange, the Customer should contact the Customer Service. If the desired color or size of the item is currently in stock, the exchange item will be sent to the Customer after the item from the initial order is returned in unused condition. We will pay the cost of returning the item from the initial order, the cost of shipping the exchanged item, and the local duties and taxes that may be incurred for the shipping of the exchanged item. 

 

1.9 WARRANTY

Samsares warrants that all Products purchased on this Website 

– comply with regulations of the Swiss law and specifications provided in the product descriptions;
– are free of material defects and workmanship errors;
– are delivered to the recipient in new and undamaged condition.

The warranty period is 24 months starting from the date of purchase which is indicated on the invoice. This warranty covers the following cases:
– when Products were delivered damaged ( in this case delivery damage must be claimed within 5 days after delivery ),
– when Products have manufacturing defects that might be hidden and appear later but within the indicated warranty period of 24 months,
– when Products are non-compliant with the legal regulations of the Swiss law which were in place at the time of purchase,
– when the Products are non-compliant with the product descriptions provided on the product page on the Webpage, order confirmation, invoice, and/or product certificate (including deliveries of wrong items, wrong size, or wrong color). 

This warranty doesn’t cover natural variations of precious stones, wear and tear from use, and damages that were inflicted on the Product after it was delivered. 

In case a wrong item, size, or color was delivered, the Customer should contact Customer Service to organize the replacement.

In case the Products were delivered damaged, the Customer should send an email to Customer Service within 7 working days after delivery, providing the order number, description, and photographs of all observed flaws. The Customer will be asked to return the item for examination by our in-house team. If the damage claim is approved, Samsares will cover the cost of returning the item and replacing it with a new item. Damages reported later than 7 working days after delivery will not be considered a warranty claim and will not be eligible for a refund or replacement. 

In case of any warranty claim occurring within the warranty period, the Customer should send an email to Customer Service, providing the order number, description, and photos of the flaw. The Customer will be asked to return the item for examination by our in-house team. If the claim is approved, Samsares will cover the cost of returning the item and send either a repaired or a new item to the Customer.  


1.10 REPAIRS

Currently, Samsares doesn’t offer revisions and repairs. If the jewelry got damaged due to wear and tear or if the Customer has any concerns about the claws holding stones or the safety of clasps, it is recommended to bring the item for revision and repairs to any professional jeweler.


1.11 CUSTOMER SERVICE

Customer Service will assist Customers with providing information, ordering, shipping, returns and refunds, exchanges, and warranty claims of Products purchased on the Website. Customer Service can be contacted in the following ways:

1.12 INTELLECTUAL PROPERTY RIGHTS  

The use of the Website is only allowed for legal, personal, private, and non-commercial purposes. It is prohibited to use the Website or any Samsares services in any way that could violate the intellectual property rights of Samsares and/or others.

All Samsares designs and models whether or not they are trademarked, registered, or patented, as well as all Content that appears on this Website and/or on Samsares Products, accessories, packaging and all marketing materials ( including logos, images, illustrations, graphics, marks, trademarks, drawings, texts, videos, music, sounds, documents, color schemes, fonts, diagrams, and layouts ) is the property of Samsares and is protected by national and international copyright and other intellectual property laws. It is prohibited to fully or partially reproduce, modify, distribute, display, or exploit in any way any of Samsares designs and any of the above-mentioned forms of the Content for any purpose and on any media without the prior written consent of Samsares.

Any violation of these provisions is subject to prosecution and penalties for copyright infringement governed by the Swiss and international trademark, copyright, and intellectual property protection laws.

1.13 LINKS TO OTHER WEBSITES

The Website may contain links to other websites and other publicly accessible webpages for the purpose of affiliate marketing and to help its Customers in searching and information gathering on the Internet. These linked third-party websites and webpages are in no way connected to the Website or Samsares. Samsares doesn’t control or monitor such linked third-party websites as well as their contents and shall not be held liable for the contents of such sites and for their privacy policies and personal data processing practices. Our General Terms and Conditions of Use and Privacy Policy do not apply to the websites of third parties. It is not permitted to create links directing users from other websites to any of the pages or parts of the Website and links from the Website directing users to other websites without the prior written consent of Samsares. Please contact Samsares at info@samsares.com if you are interested in linking the Website and other websites.

1.14 FORCE MAJEURE

In case of force majeure (i.e. events that arise due to general or local extraordinary conditions), which would completely or partially suspend, disrupt, or delay Samsares execution of its obligations towards the Customers, Samsares has a right to temporarily or permanently suspend execution of its obligations which might include postponing or canceling deliveries of the purchased Products. In case of this type of event, Samsares has a right to take all necessary measures to prevent any possible damage to itself, the Website, and the Users of the Website, which might include temporary or permanent rejection of access to the Website.

1.15 AMENDMENTS AND UPDATES

Samsares reserves the right to change, remove, and update these Terms and Conditions or parts of them at any time due to new laws or other reasons. All such changes shall be effective as of the date of publication on the Website, superseding and replacing the prior Terms and Conditions concerning the new orders placed after their publications.

1.16 SEVERABILITY

If any part of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, that provision will be severed from these Terms and Conditions, and will not affect the validity and enforceability of the remaining Terms and Conditions.

1.17 GOVERNING LAW AND LEGAL DISPUTES

These Terms and Conditions of Sale are written in compliance with and governed by Swiss law. Any disputes or claims arising out of or in connection with these Terms and Conditions of Sale and Terms and Conditions of Website Use are subject to the exclusive jurisdiction of the ordinary courts of Canton Baselland, Switzerland.

1.18 MODIFICATIONS AND UPDATES OF THE TERMS AND CONDITIONS OF USE AND SALE

Samsares retains the right to modify and update these Terms and Conditions of Use and Sale at any time. The new updated version of the Privacy Policy takes effect as soon as it is published on the Website. It is recommended that Customers read the “Terms and Conditions of Use and Sale” regularly.

This Privacy Policy together with the Terms and Conditions of Use and Sale and the Cookie Policy governs and regulates the use of the Website as well as the offer and sale of Products on the Website. This Privacy Policy refers to the processing of all personal data about Users which is collected when Users visit the Website and’or Samsares social media accounts and’or use Samsares services (hereafter ”Personal Data”). Please read these Terms, Conditions ans Policies before using this Website and ordering Products and Services on the Website. Any continued use of the Website indicates that the User has acknowledged and fully accepted these Terms, Conditions and Policies.

User’s privacy is very important to us and we are committed to protect all Personal Data collected on the Website and on Samsares social media accounts by complying with Swiss law and regulations which govern all aspects of dealing with user’s personal data. By using the Website www.samsares.com or by submitting user’s personal data to us, the user accepts the practices described in the Privacy Policy. If the user doesn’t agree to this Privacy Policy, the user should refrain from using or visiting the Website and/ or submitting user’s personal data to us. 

2.2 COLLECTION OF PERSONAL DATA

2.2.1 Data that is collected and methods of collection

Samsares collects the following types of data:

(1) Surfing data 

This type of data is collected automatically by computer tools, technologies and programs when Users visit and navigate the Website, with or without voluntarily revealing any personal information about themselves. Surfing data include User’s electronic identification data, such as information about geo-location, connection, device type, device ID or unique identifier, referral URL, IP address, traffic to and from the Website, statistics on page views, as well as information collected through cookies and web beacons. 

(2) Personal Data 

This data refers to all personal information that the User voluntarily provides to Samsares when the User:

– communicates with Samsares via email, online chats, applications or telephone;

– creates a customer account on the Website;

– orders Products;

– registers to Samsares Newsletter;

– publishes Submissions on the Website and via third party channels, such as social media accounts or communication platforms;

– fills and submits feedback forms.

Personal Data that Samsares collects include name, gender, age, email address, phone number, shipping address, billing address and financial information required for payments. Additionally, Samsares collects information relating to previous orders as well as data from communication between Customers and Samsares on the Website and on any other third-party platform.

Samsares collects surfing data for statistical, market research and technical purposes, such as to ensure correct functioning of the Website and to optimise services, functions and content provided on the Website.

– to provide Customer with all services of the Customer Service;

– to optimise Samsares marketing and communication strategies to better suit Customers’ needs, interests and preferences.

– to prevent fraud and other prohibited or illegal activities; 

e) Security purposes:

– to ensure data security and overall security of the Website.

Samsares will collect and process User’s Personal Data only if and to the extent that is described in at least one of the following provisions:

– The User has given Samsares an explicit consent to process certain User’s Personal Data for one or more specific purposes (e.g. to create a customer’s account or to receive newsletters); 
– Processing of Personal Data is necessary for the performance of a contract (e.g. to process the purchase, return or other services); 
– Processing of Personal Data is necessary for compliance with legal obligations;

2.2.4 Newsletter

On the Website the User can subscribe to Samsares newsletter. To register to Samsares newsletter, the User has to provide a valid Email address. Samsares will use this Email address to send the newsletters. The User can revoke their consent at any time by clicking the ”Unsubscribe” link in every newsletter or by contacting our Customer Service. 

Our newsletter contains cookie technologies which are associated with the corresponding newsletter subscriber’s digital ID. These cookies provide us with the following information about the sending of the newsletter: address files used, subjects and numbers of sent newsletters, information on the addresses that have or have not received the newsletter and on the addresses where delivery has failed, information on the addresses used to open the newsletter, information on the addresses that have been deleted, technical information like time of search, IP address, browser type and operating system. This information is used for statistical analysis of the sending of Samsares newsletter. The results of this analysis may be used to better tailor future newsletters to the preferences of the subscribers. These newsletter cookies are deleted when the User cancels the newsletter. The User can prevent use of newsletter cookies by setting their email program so that no HTML is displayed in message. 

By subscribing to Samsares newsletter the User gives Samsares their consent:

– to process the data for the purpose of regularly sending the newsletter to the User’s Email address;

– to use the data for statistical evaluation of usage behaviours and optimisation of the newsletter. 

This User’s consent constitutes the legal basis for data processing in accordance with the DPA and GDPR. 


2.3 STORING OF PERSONAL DATA

All collected Personal Data will be stored and processed via Samsares electronic system. 

All Surfing data will be retained for as long as it is necessary to satisfy the purposes described in the article 2. 

Insofar as  the Customer does not withdraw their consent for processing of their Personal Data nor exercise their right to be forgotten before the expiration of any of regular retainment periods, Samsares will retain Customer’s Personal Data for 5 years from the last date of Customer’s active use of Samsares services on the Website which require disclosure of the Personal Data (f.e. creating an customer’s account, purchasing, subscribing to the newsletter, opening newsletter emails, contacting Customer Care or making a Submission). After this period, Customer’s account will be deactivated and Customer’s Personal Data will be permanently erased. In some circumstances, Personal Data may be retained for longer periods of time, for instance when it is necessary to do so in accordance with legal, tax and accounting requirements. 

A Customer may close their account and/or unsubscribe from newsletters at any time. To close the Customer’s account, the Customer should contact the Customer Service in written and ask to deactivate their account. In this case, Customer’s account will be deactivated and all personal data about this Customer will be permanently erased. To unsubscribe from newsletters the Customer should click on the “unsubscribe” link included in each newsletter or contact the Customer Service. 

All financial information required to process payments will be transferred to Samsares subcontractor for payment processing, retained on that subcontractor’s system for the period of time required to execute the payment, and then permanently destroyed.

2.4. PROTECTION OF PERSONAL DATA

2.4.1 Security measures to protect Personal Data

To protects User’s Personal Data and reduce the risk of unauthorised access, disclosure, amendment, misuse or loss, Samsares implements all reasonable technical and administrative security measures such as authorisation controls to access the database, data encryption, firewalls, state-of-the-art physical and digital safeguards for the IT systems, strict non-disclosure obligations for the employees who may have access to the Personal Data and other security measures. All payments made on the Website are protected by the SSL encryption. Users’ financial information provided for processing payments on the Website is stored on the secure system of Samsares subcontractor for payments processing. However, Samsares cannot guarantee for 100% security of information contained within the Website due to general data security and privacy limitations inherent to the Internet. Except for cases of gross negligence, Samsares cannot be held liable for any direct or indirect damages that may result to the Users from the fraudulent and unauthorised use of data saved on and extracted from the Website by the third parties. Users browse, navigate and use the Website at their own risk. 

2.5 DISCLOSURE OF PERSONAL DATA

User’s Personal Data will be accessible to the internal and external employees within Samsares organisation who are bound by strict non-disclosure obligations. 

Users’ Personal Data will not be sold and/or disclosed to any third parties, except to: 

– Samsares partners and subcontractors for logistic and technical purposes, such as providers of the Website hosting and maintenance services, providers of payment processing services, carriers, independent consultants, credit bureaus, banks and financial institutions, fraud investigations, providers of bill collection services, providers of affiliate and rewards programs, etc.;

– other third parties which may be acting as communication intermediaries between the User and Samsares, for example when the User contacts Customer Service via WhatsApp or when the User makes Submissions on Samsares social media accounts; in such case User’s Data will be disclosed to these third party entities and their terms, conditions and privacy policies will apply to the processing of the User’s Data by these third party entities;

– other third parties to whom Users explicitly ask Samsares to send their information;

– other business entities, in case of Samsares merger with or acquisition by that business entity; 

– the legal authorities, such as courts, crime investigators, regulators and any other third parties if it is required by law or in connection with a legal claim or to prevent fraud.

All Customers must safeguard the security of their accounts on the Website by changing their passwords regularly and never sharing their usernames and their passwords with any third parties. Samsares cannot be held liable for disclosing personal information about the Customer to anyone who has logged into the Customer’s account by using the Customer’s login credentials.

Samsares retains the right to modify and update the Privacy Policy at any time. The new updated version of the Privacy Policy takes effect as soon as it is published on the Website. It is recommended that Customers read the “Privacy Policy” on a regular basis. Should Samsares intend to disclose the Customer’s Personal Data to any third parties in a manner that was not set out in the Privacy Policy in force at the time of the Personal Data’s collection, Samsares will inform the Customer in writing in advance of its intention, and will offer the Customer an option to refuse the disclosure of the Customer’s Personal Data.

Plugins for YouTube, Facebook and Instagram are used on the Website, which is indicated by displaying relevant icons of these social media platforms on the footer of each page of the Website. By clicking on the relevant icon the User will be directed to the Samsares account on the corresponding social media platform. Samsares has no influence neither on the extent of the personal data that these social media platforms collect through these plugins nor on the ways that this personal data is used by the providers of these platforms.
